1. Product Descriptions

House of Whimsy strives to describe all original artwork, limited edition art prints, greeting cards, and merchandise as accurately as possible.

Because computer monitors, mobile devices, and screen settings may vary, actual colors may differ slightly from those displayed online.
 

Each artwork is individually handcrafted and professionally produced. Minor variations in color, texture, or finishing are considered part of the unique character and authenticity of handmade art.

 

2. Limited Edition Prints

Limited edition prints are produced in strictly limited quantities as specified in each product listing.

Limited edition artwork may include:

• Artist signature

• Edition number

• Signed Certificate of Authenticity

Once a limited edition has sold out, no additional prints of that edition size will be produced, preserving the collectible value and exclusivity of the artwork.

 

3. Pricing and Payment

All prices displayed on the website are listed in U.S. dollars (USD).

Payment in full is required at the time of purchase. Accepted payment methods are provided during checkout.

House of Whimsy reserves the right to modify pricing, product descriptions, availability, or product offerings without prior notice.
 

4. Shipping and Delivery

Orders are processed according to the shipping timeframes stated on the website.

Delivery times may vary due to shipping carrier delays, holidays, weather conditions, or other unforeseen circumstances.

Customers are responsible for providing accurate shipping information. House of Whimsy cannot be held responsible for delayed, lost, or returned packages resulting from incorrect addresses supplied by the customer.

For international shipments, any applicable customs duties, import taxes, or fees are the responsibility of the purchaser.
 

5. Returns and Exchanges

Due to the unique nature of original artwork, handmade products, and limited edition prints, all sales are considered final.

Refunds or exchanges are not offered unless an item arrives damaged or defective. Customers are encouraged to review product descriptions, dimensions, and images carefully before purchasing.

If your order arrives damaged:

• Contact House of Whimsy within five business days of delivery.

• Provide photographs of the damaged item and packaging.

• Retain all original packaging materials.

Approved claims may qualify for a replacement, repair, store credit, or refund at the artist's discretion.

 

6. Copyright and Intellectual Property

All artwork, illustrations, images, designs, text, and website content remain the exclusive intellectual property of artist Angela Marie Franco unless otherwise stated.

The purchase of artwork does not transfer copyright, reproduction rights, or commercial usage rights.
 

Artwork may not be copied, reproduced, distributed, modified, published, or used for commercial purposes without the artist's prior written consent.

 

7. Personal Use

Artwork purchased through House of Whimsy is intended for personal use only unless a separate commercial licensing agreement has been granted in writing.

Commercial reproduction, resale, or licensing is prohibited without permission.

 

8. Order Cancellations

Orders may be canceled within 24 hours of purchase provided production or shipping has not begun.

Custom, commissioned, or personalized artwork orders cannot be canceled once work has commenced.

 

9. Limitation of Liability

House of Whimsy shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase, ownership, or use of products purchased through this website.

 

10. Privacy

Customer information is collected solely for order processing, customer communication, shipping, and normal business operations.

Personal information will never be sold, rented, or intentionally shared with third parties except when necessary for payment processing, order fulfillment, or shipping services.

 

11. Governing Law

These Terms and Conditions shall be governed and interpreted according to the laws of the State of New Jersey, USA, without regard to conflict of law principles.
